Michigan Divorce

Michigan is a no-fault divorce state. This means either spouse can file for a divorce at any time without stating a reason other than a breakdown in the marriage. However, even though fault does not have to be established in order to have a marriage dissolved, it can play a part when it comes to how property will be divided or whether and to what extent there will be spousal support.

  • Alimony. Whether a Michigan court will use its discretion to order one spouse to pay alimony, also called spousal support, to another depends on several factors, including each spouse’s age, health status, financial needs, earning capacity, conduct during the marriage, and contribution to the marriage. We will be your strong advocate in that any alimony awarded in your case is fair to you and takes into account your unique circumstances.
  • Property Division. Michigan courts divide a divorcing couple’s real and personal property into two kinds: Separate (owned before the marriage or received as a gift or inheritance) and Marital (acquired during the marriage). Michigan is an equitable distribution state, which means the court will distribute marital assets and debts in what seems to be a fair manner, which does not necessarily mean equally divided. We will help you reach an outcome regarding property division that not only ensures you receive a fair share of assets but that you also keep what is most important to you.

Child Custody and Child Support

Michigan law requires the court to presume it is in the best interests of the children to maintain a close relationship with both parents. If the parents agree on joint custody, the court will usually agree and order it, unless it would not be in the children’s best interests. Depending on the circumstances, a court can also award one parent physical custody of the child and will create a visitation schedule for the other parent, or may even order a guardian to be a child’s primary caregiver. Under Michigan family laws, child support amounts are determined by using the Michigan Child Support Formula taking into account factors like the income of each parent, the number of children being supported, actual childcare costs, and parenting time schedules. Most nuptial agreements tackle real estate, division of bank accounts, or spousal support in the event of divorce or separation. Couples can seek prenuptial and postnuptial agreements for a wide variety of reasons. However, drafting an enforceable agreement can be complex, and getting it right is critical. While Courts often uphold prenuptial and postnuptial agreements, there is a number of reasons why the same may be vulnerable to attack, which is important for both parties to understand when entering into a prenuptial and postnuptial agreement.
