Changes to Michigan Medical Marijuana Act

Dan Williams, Esq.

Two cases involving medical marijuana, People v Bylsma and People v Overholt, Jr., were recently heard by the Michigan Court of Appeals. Each consisted of a caregiver who faced charges for transacting with other caregivers in addition to patients. The question became whether these transactions violated the Michigan Medical Marihuana Act (MMMA), which the Court answered "yes."

With this Opinion, the Court has created new methods to prosecute both patients and caregivers. If you are a medical marijuana patient or grower, be certain that you are abiding by the MMMA as stipulated in this Opinion. In the event you are facing criminal charges in violation of the MMMA, contact Dan Williams at (248)-912-3312 or via email at [email protected]. Dan has extensive experience in drug-related projects from his time as a prosecutor in Wayne County and a Criminal Defense attorney in Southeastern Michigan.
