Two cases involving medical marijuana, People v Bylsma and People v Overholt, Jr., were recently heard by the Michigan Court of Appeals. Each consisted of a caregiver who faced charges for transacting with other caregivers in addition to patients. The question became whether these transactions violated the Michigan Medical Marihuana Act (MMMA), which the Court answered "yes."
With this Opinion, the Court has created new methods to prosecute both patients and caregivers.
