Types of Claims

Our attorneys handle VA claims that involve:

  • Post Traumatic Stress Disorder (PTSD)
  • Traumatic Brain Injury (TBI)
  • Agent Orange
  • Dependents Indemnity
  • Amputation
  • Psychological cases
  • Disability compensation

At the Regional Office, Board and Court of Appeals level, the hardest claims to get granted are PTSD, Traumatic Brain Injury (TBI) and those with undiagnosed or weak medical causation linkage. TBI claims are increasing as a result of the war in Iraq. It is estimated 70% of Iraq combat veterans suffer from mild to severe TBI and 11% - 18% of Afghanistan and Iraq veterans develop PTSD. Veterans of the Gulf War, Vietnam and Somalia also suffer from PTSD and TBI.

The Claims Process

In order to qualify, you have to be a veteran or dependent. After you file the claim, the VA Regional Office obtains copies of the veteran's service and medical records. After the relevant evidence has been collected, the VA will issue a determination on the claim, called a "rating decision", which will either grant or deny the benefit.

If the VA denies the claim, the veteran has one year to appeal. Please access the following link to learn more about the VA claims process.

How We can Help

We are allowed to represent a client only after the VA has denied their claim the first time. We handle all the administrative details, working with the client and our staff to ensure the best result possible.

By law, the VA claims process was established to be pro-claimant and non-adversarial. In reality, the VA is anything but. Furthermore, claims statistics reveal 33% of appeals are dismissed on legal technicalities. Therefore, it is important that the veteran engage a lawyer that can bring an aggressive approach to the claims process. Please access the following link, to learn more about the VA appeals process.
